These Terms and Conditions ("Agreement") govern your use of the Hearthlink website at hearthl.blog and your participation in any programme or session offered by Hearthlink ("we", "us", "our"). By booking a programme, submitting an enquiry form, or using this website, you confirm that you have read, understood, and agreed to these terms.
1. Definitions
- "Service" means the educational workshops, planning sessions, and coordination programmes offered by Hearthlink, as described on this website.
- "User" / "you" means any individual who visits the website, submits an enquiry, or participates in a programme.
- "We / Us / Our" means Hearthlink, operating from 68, Jalan SS2/24, 47300 Petaling Jaya, Selangor, Malaysia.
- "Programme" means any of the three Hearthlink offerings: the Calm Conversations Workshop, the Shared Planning & Records Organisation session, or the Continuing Family Coordination Programme.
- "Content" means all materials provided by Hearthlink during a programme, including guides, templates, checklists, and binders.
2. Acceptance of Terms
By using this website or booking a programme, you agree to be bound by this Agreement. If you do not agree, please do not use this website or book any programme.
You must be at least 18 years of age to book a programme independently. Participants under 18 may only attend with the consent and presence of a parent or legal guardian, who must agree to these terms on their behalf.
3. Service Description
Hearthlink provides educational workshops and practical coordination sessions for families navigating a period of household change. Our programmes are purely educational in nature. We do not provide legal advice, therapeutic counselling, financial advice, or any service that requires a professional licence.
Sessions are delivered in person at our office in Petaling Jaya, Selangor. Remote participation for parts of a session may be arranged by prior agreement. Our services are available to families residing in or able to travel to the Klang Valley, Malaysia.
4. User Responsibilities
By participating in a programme, you agree to:
- Treat all other participants and Hearthlink facilitators with respect throughout sessions
- Not record sessions (audio or video) without the explicit written consent of all participants and Hearthlink
- Provide accurate information when completing enquiry and booking forms
- Attend sessions at the agreed times, or provide reasonable notice if you need to reschedule
- Not use any programme content or materials to misrepresent Hearthlink's services or scope
We reserve the right to end a session early if a participant's conduct is disruptive or disrespectful to others in the room.
5. Intellectual Property
All workshop frameworks, templates, checklists, guides, and other written materials provided by Hearthlink ("Content") remain the intellectual property of Hearthlink. You are granted a personal, non-exclusive, non-transferable licence to use the Content for your own family's private use following programme participation.
You may not reproduce, distribute, sell, or publicly share Hearthlink Content without prior written permission. You may not use Content to deliver your own workshops or educational sessions based on our frameworks.
6. Payment Terms
Programme fees are as follows (all amounts in Malaysian Ringgit):
- Calm Conversations Workshop: RM 560
- Shared Planning & Records Organisation: RM 2,000
- Continuing Family Coordination Programme: RM 4,450
Payment is required in full via bank transfer prior to the first session. Payment details are provided upon booking confirmation. All stated fees include the cost of materials (guides, templates, checklists, family binder where applicable).
Cancellation and rescheduling
- Cancellations made more than 7 calendar days before the first session: full refund, less a RM 100 administrative fee.
- Cancellations made 3–7 calendar days before the first session: 50% of the programme fee will be refunded.
- Cancellations made fewer than 3 calendar days before the first session: no refund, but the session may be rescheduled once at no additional cost, subject to availability.
- If Hearthlink cancels a session for any reason, a full refund will be issued or the session rescheduled at your preference.
7. Programme-Specific Terms
Scope of service
All Hearthlink programmes are educational only. Nothing communicated during a session constitutes legal, financial, therapeutic, or professional advice of any kind. Facilitators will clearly indicate when a matter falls outside Hearthlink's scope and will direct participants to appropriate professionals or official bodies.
Session recordings and notes
Hearthlink does not record sessions. Facilitators may take brief internal notes for programme quality purposes only. These notes do not include verbatim personal disclosures and are not shared externally.
Programme completion
For the Continuing Family Coordination Programme, the full programme fee is due before sessions begin. Sessions are delivered in an agreed sequence and at an agreed pace. If a family is unable to complete all sessions for reasons beyond their control, we will work reasonably to find a suitable arrangement.
8. Disclaimers
Hearthlink's programmes are provided "as is" as educational experiences. We make no representation that participation will lead to any particular outcome for your family situation. Communication workshops and document organisation sessions are tools — how they are used, and the results that follow, depend on the participants.
Hearthlink is not a law firm, counselling practice, or mediation service. We do not represent any party in any legal or official proceeding. Nothing we provide should be treated as a substitute for independent professional advice.
9. Limitation of Liability
To the fullest extent permitted by Malaysian law, Hearthlink's total liability to you arising from or in connection with a programme shall not exceed the fee paid by you for that programme.
We are not liable for any indirect, incidental, or consequential loss, including loss of opportunity or damage to relationships, arising from your participation in a programme or use of our website.
Nothing in these terms limits liability for death or personal injury caused by our negligence, or for any other liability that cannot lawfully be excluded.
10. Indemnification
You agree to indemnify and hold harmless Hearthlink and its staff from any claims, losses, or expenses (including reasonable legal costs) arising from your breach of these terms or from your conduct during a programme session.
11. Termination
Either party may withdraw from a programme before it begins, subject to the cancellation terms in Section 6. Once a session has commenced, Hearthlink may end a session early if a participant's conduct is disruptive, with no refund obligation for the session delivered.
Sections 5 (Intellectual Property), 8 (Disclaimers), 9 (Limitation of Liability), 10 (Indemnification), and 12 (Dispute Resolution) survive termination of this Agreement.
12. Dispute Resolution
This Agreement is governed by the laws of Malaysia. The courts of Malaysia shall have exclusive jurisdiction over any dispute arising from it.
Before initiating any formal proceedings, both parties agree to attempt to resolve any dispute informally by contacting us at [email protected]. We will respond within 14 days and make reasonable efforts to reach a mutually acceptable resolution.
Participants may also have recourse to the Tribunal for Consumer Claims Malaysia for claims within the applicable monetary limit under the Consumer Protection Act 1999.
13. General Provisions
- Entire agreement: This Agreement constitutes the entire agreement between you and Hearthlink in relation to its subject matter and supersedes all prior communications.
- Severability: If any provision is found to be unenforceable, the remaining provisions continue in full effect.
- Waiver: Failure to enforce any provision of this Agreement does not constitute a waiver of that provision.
- Assignment: You may not assign your rights under this Agreement without our written consent. We may assign our rights and obligations to a successor organisation without notice.
14. Changes to Terms
We may update these terms from time to time. The "last updated" date above will change when we do. Continued use of this website or booking of a programme after changes are published constitutes acceptance of the updated terms. For material changes, we will make reasonable efforts to notify participants whose programmes are underway.
